A family mediator must maintain impartiality and prevent any potential conflicts of interest. This means that a mediation is barred from resolving a dispute for which they have acquired relevant information about the parties. In particular, a mediation must retain neutrality regarding the mediation’s conclusion. They may well not try to impose their desired outcome or exert outsized influence on one of the parties.
You also must expect the mediator will keep any information obtained during the mediation session secret. Without the approval of both parties, the mediation is forbidden form disclosing any information to the court. The mediators may only provide information where severe claims of damage to a child or adult are present.
Mediation is a voluntary procedure, and any mediation session may be delayed or cancelled if it is determined that the parties are reluctant to participate completely. Additionally, mediators must urge the parties to consider the desires and emotions of the children.
